Two fifth-grade boys brought weapons to school to use in a murder plot that involved killing a female student at their school, according to a report on NBC News Feb.16.
The 10 and 11 year old boys are charged with conspiracy to commit first-degree murder stemming from a failed plan to murder one student and harm others by luring them one by one away from the school according to Tim Rasmussen, a Stevens County prosecuting attorney.
A judge will rule next week as to whether or not the boys had the mental capacity to carry out their plan and whether or not they can be tired in juvenile court which is usually reserved for children ages 12 to 18.
A fourth grade student saw the 11 year old with a knife on the school bus that morning and reported it to a teacher’s aide. The 10 year old was found in possession of a working Remington Model 1911 semi-automatic handgun that he allegedly took from an older brother’s bedroom.
School officials at the elementary school in Colville, a city of 4,600 residents, found the weapons before the boys could put their plan into action. Police were called. The boys were arrested and are currently in a juvenile detention center.
The 11 year old told police the plan was to lure the girl away from the school where the 11 year old would stab her to death. The younger boy said it was because she was always being rude and picking on him and his friends. The 10 year old would use the gun to keep away anyone who tried to interfere.
In addition to the murder conspiracy, the 10 year old is charged with being in possession of a firearm and tampering with a witness. The 11 year old faces additional charges as well including juvenile firearm possession conspiracy and tampering with a witness.
They could receive more than three years in a juvenile facility if they convicted on all charges.
