A Phoenix man was arrested and charged with first degree murder on New Years Eve for killing his teenage son with an ax according to abc15 on Jan. 1, 2014.
The victim's mother called police when her ex-husband, 51-year-old Gary Sherrill failed to bring their 13-year-old son David home following a visitation. Sherrill and his ex-wife had shared custody of David according to police.
When officers arrived at Sherrill's apartment, he told them his son was not at home. Phoenix police Sgt. Steve Martos says after officers continued to question Sherrill, he allowed them into his apartment.
Once inside the home, David's body was found with multiple stab wounds and lacerations. Martos says Gary Sherrill believed his son was a demon and was scared of him. He confessed to killing him with an ax and told officials he thought David was going to eat him.
Gary Sherrill had been acting strange lately according to his neighbor Davina West. She told officials he was recently seen screaming at a tree. Another neighbor said there was plenty of drama between David's parents.
"The parents were arguing, the mom was on the street, the dad was up by the apartment and the child was in the middle," said an unidentified woman.
Gary Sherrill is being held at the Maricopa County Jail.
