While nothing may have actually happened on the tape, Grey's Anatomy veteran Eric Dane and wife Rebecca Gayheart are suing Gawker.com for posting the sex tape on their website four months ago.
The tape, which included former beauty queen Kari Ann Peniche, was four minutes long and featured no actual sex, but just some naked running around and smoking marijuana. Then Gayheart and Peniche took a naked bubble bath.
According to TMZ.com, Gayheart and Dane filed a $1 million lawsuit in L.A. County court on Wednesday, claiming that the website had not only unlawfully posted almost 4 minutes of the private video that was shot behind closed doors, but "maliciously" distributed the video and included nude shots of the threesome.
The couple is suing for $1 million in damages, and their lawyer, Marty Singer, is asking for an injunction to pull the plug on their video.
Gawker.com's publisher, Nick Denton, twittered this response: "To quote the great Marty Singer--Eric Dane's lawyer--if you don't want a sex tape on the internet, 'don't make one!'"
