Colorado’s embattled real estate director Erin Toll says she has a target on her back.
It’s been put there by state Sen. Ted Harvey and Barbara Kelley, executive director for the Colorado Department of Regulatory Agencies, Toll alleges in an appeal to the state’s personnel board.
Toll filed the appeal by fax Thursday.
She requested to be returned to her job and is seeking whistleblower protection.
The appeal, obtained by Examiner.com, answers several questions that have been making the rounds since Toll was suddenly put on leave by Kelley March 16.
Toll was put on leave involuntarily for stating that Harvey, a mortgage broker at American Home Funding was under investigation. The following day, the Department of Regulatory Agencies issued a retraction.
“I believe that I am being retaliated against for providing information concerning Mr. Harvey’s connection to American Home Funding to a member or members of the Legislature,” while she was 'protected' Toll said in her appeal.
Other elements of Toll’s appeal:
The Retraction: Toll says the retraction made it appear that she had provided inaccurate information. “Mr. Harvey was, or is being investigated or should be investigated, as well as numerous other licensees of American Home Funding,” Toll alleges.
The media: Toll says she was muzzled by Kelley. “It is my position that such limitations on statements to the press, when I am under personal attack, and the ban on my contact with employees, is a violation of my rights under the state and federal constitution and state law that infringes on basic rights, including liberty rights, association rights and free speech rights. It also prevents me from engaging in whistleblowing.”
Termination: Toll says that she has been “constructively terminated from employment” by Kelley’s actions and that she has been targeted for termination.
Interference: Toll says Kelley interfered with her duties, labeling it “an abuse of power and mismanagement.”
Kelley’s spokesman didn’t return a phone call.
Harvey was in session, an assistant said.
