Recently, Examiner.com was the first news outlet to report that the Eddie Long divorce case had been closed and dismissed without prejudice, according to the DeKalb County Online Judicial System.
See the article titled “Eddie Long’s divorce case closed, dismissed without prejudice” – published on February 15, 2012 – a mere two days after the judicial website reported the divorce case closed.
Now one of Bishop Eddie Long’s lawyers is confirming that it was indeed the pastor’s wife who called off the divorce.
“Lawrence Cooper confirmed to The Atlanta Journal-Constitution that Vanessa Long had asked that the divorce petition be dismissed,” writes AJC.com, indicating that Vanessa Long’s lawyers have yet to respond to their queries about the on-again, off-again divorce updates of the embattled New Birth Missionary Baptist Church leader.
As originally reported, a dismissal does not mean that the divorce case could not be re-opened by either party re-filing a divorce claim in the future.
“If you are unable to obtain either service or waiver of service by the opposing party, your case may be dismissed without prejudice,” writes the Judicial Branch of Georgia website, explaining, “A dismissal without prejudice does not stop the plaintiff from re-filing the claim and proceeding as long as the claim is made timely (within the statute of limitations) and service can be secured.”
