E*TRADE wants Lindsay Lohan lawsuit over Super Bowl ad dismissed (video)

If E*TRADE has their way, former teen star Lindsay Lohan will have one less reason to show up in court. According to TMZ, the finance company is hoping to persuade a judge to dismiss a lawsuit filed by the "Mean Girls" star earlier this year, in which a claim was made that the company's Super Bowl commercial was using her name without her consent.

In the ad (which you can see below), the E*TRADE baby -- who is a common mascot for the company -- is talking about his portfolio when his girlfriend asks him if he has been spending time with a "milkaholic" baby named Lindsay. Lohan -- who has seen her share of reported troubles with substance abuse and will even appear in court for a DUI probation case on May 20 -- believes that her name is recognizable to the point where the baby's name is an obvious reference to both her and her history of struggles.

There's no word yet on what the judge will actually decide, but it's fairly clear that both parties have better things to tackle right now than a lawsuit from a commercial most people have forgotten about at this point.

Do you think E*TRADE will succeed in getting the suit dismissed? Let me know your thoughts with a comment and stay tuned for more of the latest news.
