DUI cases: Man guilty in crash that killed 2, Repeat DUI offender charged with perjury

An Aurora man has pleaded guilty to a drunk driving accident that killed two of his friends back in 2007.

Thomas Ofenloch, 26, of the 1300 block of Balmoral Court agreed to plea to two counts of aggravated DUI and one count of DUI, according to a statement from the Kane County State's Attorney's office.

He faces between 6 and 28 years in prison when he is sentenced in April.

On August 4, 2007, Ofenloch was driving his two friend in a Nissan Sentra when he crashed into a tree near Sugar Grove.

Joshua Sutton and Andrew Berger, both 21 and both from Batavia, were killed.

Investigators say Ofenloch had a blood-alcohol content of .101, well above the Illinois limit of .08.  Tests showed he also had marijuana in his system.

A Lake Zurich man is in legal trouble after he allegedly lied under oath about his history of drunk driving convictions.

Bradley Baldino, 38, is charged with perjury, which is a felony.

Baldino was on trial in December on a DUI and reckless driving charged when he was asked by the judge if he had any previous arrests for driving under the influence.

Courts documents show Baldino answered "no" to the judge's question. When she then asked him "are you sure?", he said "yes".

Well, that apparently was not the truth, the whole truth and nothing but the truth. After Baldino was found guilty of only the reckless driving charge, the Cook County State's Attorney's office decided to delve a little deeper into possible arrests in other jurisdictions.

Prosecutors say they found Baldino had two prior convictions for DUI, one in Lake County and one in California. Police re-arrested Baldino on the perjury charge this week.

Police say they found him sitting at the Scoreboard Bar in Lake Zurich. He told the arresting officers he owns the bar.
