The federal government war against marijuana is lost, but federalists refuse to concede defeat and the Department of Justice, using the DEA and even the IRS, continue to raid, harass, and even incarcerate growers and users alike. The states of Washington and Colorado have completely withdrawn from the senseless war by legalizing recreational use of Marijuana and the federal government has no legal and moral standing to oppose them.

Amendment 10 of the Bill of Rights clearly limits the powers of the federal government to those delegated by the States and the people and there is nothing in the U.S. Constitution that gives the federal government plenary power over an organic drug like marijuana, or other drugs for that matter, and States and citizens have not abdicated such power. Citizens surveyed reveal that 64 percent said that States that legalized recreational use of marijuana should not be trumped by federal anti-marijuana laws and even those opposed say that states should be allowed to set their own marijuana policies. The federal appointment of a "drug czar" is abhorrent in so many levels.

Marijuana legalization is also a matter or economics. Instead of prohibition, the taxation and regulation of marijuana like alcohol and tobacco will generate billions for government coffers and enactment of well-thought of policies and regulations transforms criminal prosecutions into prevention, treatments and rehabilitations. Over 500 notable economists wrote an open letter to governments about the economic benefits of legalizing marijuana. It is also a matter of personal liberty.

It is time for the federal government to withdraw from the unilaterally declared drug war. Powers of the States and People must be recognized and that the federal government is only a servant of the states. The murmured voices of the silent majority is getting louder and must now be heard.
