Photo credit: APThere are many contradictory reports in the Tiger Woods scandal. One report states that the couple is together, while another says they are in separate homes. One says they are committed to restoring their marriage and another says they are 100% getting divorced.
Though we can’t know for certain what the couple plans to do, we can find out from divorce lawyers how things might transpire should certain scenarios transpire. Tonight, Vikki Ziegler gave a televised interview and discussed several aspects of family law that would be relevant to Tiger and his wife, Elin should the couple get divorced.
One of the points that was made is whether or not Tiger Woods would state that he wants full custody of his children from a PR point of view. It has been reported by unverified sources that Elin Woods wants full custody of the children. Should she seek full custody, she would need to prove that Tiger Woods is unfit as a father. Though he has been accused of serial infidelity, a family court may have issues equating his behavior with other women as an indication of being a poor parent. Let’s face it, if all parents lost custody of their children for infidelity, there would be very few family units left.
How Tiger conducted himself outside of the home does not necessarily mean that he has had no contact with his children. If however, it can be proved that he spent months away from his children at a time and during that time he was with his alleged lovers, Elin might have more legal ground to stand on. On the other hand, some rumors have stated that Elin is planning on whisking the children away from Florida and moving them to Sweden. Legally, she would not be able to do this and Tiger would have many rights that would enforce Elin to stay in the states with the children.
No one knows what Elin and Tiger plan to do but should Elin and Tiger seek a divorce and one or the other wants full custody, this may become one of the ugliest divorces yet.
