The ultimate questions were asked again so here is the answers again. I do not know or maybe. How is that for an answer? The questions are who gets sued and who are called in or subpoenaed for information and when is the criminal case? Are others who helped them just as guilty of the crimes? The real simple answer is that there is no answer. It really depends on the person who has refused to do anything to stop the lawsuit. In my case that was mentioned it really is pretty simple from what I have been told. Even if the civil case is filed the other side of that coin could be criminal cases. Yes I said cases. By withholding or removing copyrighted materials from the copyright holder several federal statues have been broken not just the taking of the files. The scenario is pretty simple really. Anyone that person has been in contact with, lived with, dated, or had contact with including any and all relatives and friends are subject to interviews, subpoenas and summons to court as witnesses or even defendants depending on the findings. With the taking of the files, the admission of doing it and the refusal to return them that person has involved everyone because the files could be transferred or held by someone as simple as a relative or boyfriend or girlfriend. Anyone on the social media sites that are or where “friends” if there is or has been contact. As I have said, be careful because it opens up a major can of worms for a lot of people based on one person’s lack of concern for them and their own personal pride. The pride will go away when everyone they know gets the paperwork. There are people who will need to submit a lot of evidence concerning the all phases of the taking, transporting, storing and aided the person who took the items. Many of them knew she took them and that is not good for them. It could make them a defendant on their own. Your case may or may not be close to this so check it out with the pros and not the neighbors, family or friends. Keep your distance and make decisions on facts not emotions.
You also need to remember that you may be a witness in the case. Now in this particular case all the evidence is being supplied by the defendant. If you are a felon and in jail it does not matter, this is not about you but about what someone else did and in my case they admitted it. They will be investigated for violations of court orders, selling other peoples personal property, fraud and any kind of major false documents. All that is normal, it is not specific to this case or person. Your case may be a little different but it all comes down to the defendant not you. This is not about you especially with evidence supplied by the defendant’s own hand. A defense lawyer would be crazy to let it go to court especially like in my case. The person has never publicly or to me denied stealing the files.
I did have one question asked that is somewhat relevant.
What if the disk was hers? As it was put to me it does not matter. She acknowledged she took the files. She knew they were not hers. The example I was given is if I leave something in someone’s car. It is not theirs, it is still mine. If they refuse to give it back after acknowledging they have it. It is felony theft. If someone helps to or store it for them they are also guilty. If they sell the car the charge of selling stolen property is added and the person who has the disk can be charged for receiving stolen property. You get the point. You need to be careful and be sure you understand the process. We have all seen the reports of people being charged with dozens of violations and their relatives also being charged. You also see people trying to deflect it back to the other person or the prosecutors. The person who took the items is the only one responsible unless others helped them then they all are guilty. The only way to determine that and also to see if they all can be held civilly liable is to get information. Thus the summons and subpoenas. The criminal cases are normally filed first as then the civil case can use the information gotten by the prosecutors without paying the fees and grief from people not wanting to cooperate. You might want to consider that option as I am.
