There is a nice article being done on the magazine site showing a very nice black and white shot from the Grand Canyon that prompted someone to ask if it was out of a book. Not yet but it may be before long. It is a shot I took a couple of years ago on a shoot. It was shot with a Nikon D700 and a Nikon 70-200 f2.8 VRII.
I am putting together an article on how to shoot black and white images. If you like a photo but think it would be better in black and white I will show you how to change it from color to black and white even without Photoshop using a free program.
The only thing I am going to say about the article yesterday is that people over think things. If you are going to drag everyone associated with the other party into court than make sure you know what you are getting into. Can you do it, of course you can. My take on it is I will get my library back at all costs to anyone they have even talked to if I have to do it that way but that does not mean not being smart about it. Can I bring people into Colorado yes I can, it is not very expensive to do that. You can file the paperwork yourself if you wish. I do not recommend that course. There are the summons and subpoenas that will need to be done. Now comes the parts that you need to consider. You can have statements done and information shipped so be smart and be fair. The real difference between my case and the one that asked me about theirs is that in my case they took the HR image files. That is a whole new ballgame. As the attorneys have stated, it changes the game considerably. I know the word steal is harsh, but it is theft and when you are talked to about it they will not be nice and PC they will call it theft and stealing so get used to it if you are going to do this. This is where the saying, get your hands dirty, comes in to play. It is also why I told you to get an attorney and make the decisions based on facts and then let them deal with it. Just make sure you give them ample time and ability to return the images. If they do not, then either proceed or let them take them away from you. I would bet a lot of money they would not let you take a pencil from them nonetheless images that are important to you. Yes, I am considering the legal course as it was the last thing me and the attorney discussed. Any action will be done before it is posted here but as I have stated, my focus right now is stopping the infringements from growing. I have three that I will probably take to court. The others are getting worked on now. I could have gone after those three first but that would have allowed the infringing to grow and get out of hand. I have chosen to slow it way down and then tackle those three. Right now the infringing has slowed to a crawl so things are looking up.
