The 5th U.S. Circuit Court of Appeals ruled late Thursday that a lower court acted correctly when it struck down Obama's illegal, ideology-driven attack on American energy exploration over the Gulf oil spill.
The court concluded that the White House had no authority under the law to issue sweeping decrees shutting down entire industries on a whim, except for cases in which it could demonstrate that allowing the industry to continue operating threatened "irreparable injury" to the federal government.
And one major (and highly suspicious) disaster in sixty years of offshore drilling clearly does not qualify. As I have argued before, it would be like President Bush shutting down all aviation because of 9/11.
It's an absurd over-reaction that conveniently fits right in with Obama's economy-killing crusade against energy companies.

The only way ANY political party enjoys legislation is when it tends to favor the way they lean. What a stupid statement to make... The difference between liberals and conservatives is the conservative is usally more supportive when the court upholds the Constitution. Liberals tend to like the outcome more if the decision handed down is anti-establishment.
The only way the President can successfully declare marsall law is for the military/law enforcement to support his decision. I simply don't see that happening....the military seems to see him as inept and arrogant and the rest of the world sees him as naive and arrogant.

On this surface this is great news, however, Obama is using the EPA to shut down oil drilling in the Gulf. In this instance, as always, if the congress or courts rules against him he uses one of the fed agencies to do the dirty work. The EPA stop issuing new permits in April, before the oil disaster and new EPA rules have existing companies in the gulf running for cover. Once again Obama has committed a treasonist act and continues to get away with it.
