County limits gatherings at homes? Extreme proposal sparks outrage in Va. county

A Virginia county wants to limit gatherings at the homes of individuals and the measure, which is being considered by the Fairfax Board of Supervisors, is a lawsuit waiting to happen, a Fairfax County supervisor said. A report today from Watchdog.org explained that the zoning changes would limit “group assembly” at residences to 49 people a day. And such gatherings “shall not occur more frequently than three times in any 40-day period.”

The measure was first brought up because county residents often complained about large, rowdy crowds in residential areas which would cause a traffic nightmare. County officials say the events have ranged from religious meetings, social clubs and family gatherings, according to WTOP.

Supervisor Pat Herrity has strongly criticized the proposal and he fears that the bill is a violation of one's rights. In a statement regarding the issue, Herrity said : "This is yet another instance where we appear to be punishing the many for the actions of the few. I believe this proposal also has the potential to impact many large families that gather on a regular basis, community group meetings and holiday gatherings."

The proposal came shortly after a 15-year-old had to be hospitalized after she overdosed on alcohol during a house party in the county. Fairfax County Police spokesperson Lucy Caldwell said that there were about 50 teens at the residence.

John Whitehead, an attorney and president of the civil-libertarian Rutherford Institute, is strongly against the proposal and he even deemed it as being “nefarious.” He gave the following statement during an interview with Watchdog.org.....“Broad enactments like these have governments assuming that private property is their property,” Whitehead said.
