Marcos Espinal, 34, was arrested Oct. 20 after being stopped by state troopers on the Southern State Parkway at 3 a.m.
Police said they stopped his white Acura after a trooper observed the vehicle “moving in and out of its lane unsafely” near the exit for the Meadowbrook State Parkway. After Espinal was pulled over, the trooper smelled alcohol on his breath, a police news release said. At the time, his 5-year-old child was in the car.
According to authorities, Espinal failed a sobriety test given at the scene. After his arrest, he was given a breath test and produced a blood-alcohol-content of .22 percent, police said.
He was charged with aggravated driving while intoxicated, endangering the welfare of a child, second-degree aggravated unlicensed operation of a motor vehicle and other traffic violations.
Espinal is due to be arraigned at a later date amd will appear at First District Court in Hempstead.
