The Board of Health has posted a "Notice of Emergency Rulemaking Hearing" to be held on Tuesday, November 3, 2009 at 10:30 a.m. This hearing proposes to eliminate the Board of Health definition of "significant responsibility for managing the well-being of a patient", since it conflicts with the recent Court of Appeals interpretation of the Constitutional definition of "primary caregiver" contained in the People v. Clendenin case.
This is from the Board of Health announcement:
Pursuant to C.R.S. 24-4-103(6), the State Board of Health will hold an
emergency rulemaking hearing to consider the repeal of 5 CCR 1006-2,
Regulation 2(A)(iii) (definition of "significant responsibility for
managing the well-being of a patient.") to remove the rule's conflict with
the Colorado Court of Appeals decision in People v. Clendenin, No. 08CA0624
