In the world, today, over 25,000 children died, some good portion of those deaths caused by the actions of governments around the world. Yet in Minnesota, but it could be anywhere, a Judge has decided to leap upon a great White Horse, and, with the help of a merry band of gunmen, save a teenager's life through the use of invasive medical technology, by force, against the will of Daniel and both of his parents. The question is why. The answer will come in segments.
The story reads like something from an Aldous Huxley novel, or perhaps A Clockwork Orange. There is a sick thirteen year old but with cancer, a kind they say can be treated, who chooses, along with his parents, to seek other than approved treatment, and is ordered at the threat of violence to undergo invasive treatment against his will, and the will of his parents. There is so much so very wrong here that it is hard to know where to begin. First, there is the near Mengele worthy horror that the “court” has ordered to occur in this case. The “court” has literally ordered, for the boy's own good, that the boy(as soon as he and his now fugitive Mom are caught)undergo recurring deeply invasive medical procedures in the face of the boy's, not his parent's, claim that he will defend himself as best he can.
Think about what the above paragraph means. Your body is sacrosanct, one of the worst crimes short of murder is rape-the violation of that sanctity against the victims will. It is no coincidence that the physical expression of love involves the willing breach of that sanctity. But what is being ordered here goes far, far beyond sexual violation, Daniel will violated by chemicals, and radiation, to the absolute core of his being. Chemotherapy is a horrid experience for the willing, but the thought of it's effect upon the unwilling is simply monstrous.
We are not, it should be remembered, in either the case of the parents or of Daniel, dealing with people unable to reason-they simply disagree on the treatment path. They wish to use treatment offered in the “alternative” medicine field. Which is a far different thing than denying reality or otherwise being outside the realm of competence. They may be choosing a foolish path, personally I think so, but they are attempting to address the situation-meaning there is no neglect, simply a different choice. If you are to believe in freedom, then it has to apply in the tough cases as well as the easy ones. When it is life and death, and when you don't agree with the choice.
The idea that somehow Daniel is outside of the decision making process because he has not yet reached an arbitrary age is despicable. This is a person who has been diagnosed with cancer, and has undergone chemotherapy, I would suggest that he likely has a better developed notion of the realities of life and death than virtually all of the people who are five years older and have obtained official personhood, and probably at least one Judge.
Perspective is important here, death is a part of life and the pervasive modern view that we are all somehow near immortal but for lack of some type of technological interference is silly, we are all going to die. People die all the time for all manner of reasons, so how is it that cases like this where a politician(judges are usually elected, as are prosecutors)chooses to become savior manage to garner such attention? Is it simple political theater, or is it a slide from freedom toward an elitist society of “expert” rulers to control the huddled masses, such as devised by Plato? The moral puffery that one hears from people advocating force in these instances is both immature and misguided-there are, in fact, things worse than death. While in so many ways, life has become far too cheap in the West, in some ways it is far too expensive.

Michael, congratulations for having the guts, courage to say it and so well!
I just found out today talking to a doctor pioneer in the field of Hyperthermia cancer treatment, that Daniel's lymphoma can be successfully with Hyperthermia, an excellent alternative to toxic chemotherapy, "point of no return" surgery, and burning high radiation dose. There are other alternative therapies that also work on Hodgkin's lymphoma.

If chemotherapy had a 100% success rate, with no terrible side-effects, forcing him to take it would still be wrong. But chemo doesn't have that high a success rate, and it does have horrible side-effects. I have seen people live the last months of their life in a "chemotherapy-induced hell". And I have seen people choose to forego treatment in order that their last months could be happier. Their life; their choice.
Big Pharma wants their money. And the judge is bought and paid for.

Why did you omit the fact that Daniel, being 13 years old, is not able to decide for himself what is best? He cannot read and he has a learning disability. Too bad you don't state all the facts, sir! IMO, it seems to me that Daniel has been brainwashed by his mother.

I wonder about your reading acumen-I spent an entire paragraph on his age-I find it horrendous that freedom is denied to people under arbitrarily set "ages". I don't recall reading anything about a "learning disability", I may have missed it, but I hardly think it matters-is being able to read a prerequisite to be free?

I understand your concern, I really do, but I'd suggest that you consider that there is an entire Continent-Africa-where children die at medieval rates for want of the simplest of medicines. Yet they can't get them due to corruption there(and here). Why not focus your energy on the millions of people facing death that want help, rather than advocating force against the few who don't? It's good triage, and the moral thing to do.
Given his stage and type of tumor, he could normally expect at least an 85% chance of surviving and perhaps even greater than 90%, wherea without therapy he is certain to die of his disease, barring a rare spontaneous remission. If you don't have the intelligence, ability to reason, or the courage to make the right decision, then sometimes the right decision has to be made for you.
Sorry, but the boy's parents do not have the "freedom" to sentence him to near-certain death through lack of treatment. Boo-hoo for the infringement upon the "rights" they never had to begin with.
