On March 16, 2013, ABC News reported Choco Treasure is a Kinder inspired chocolate surprise egg that can now be purchased in the U.S. The product has the same prize method like Cracker Jack.
Many have tried to smuggle these Kinder Surprise chocolate eggs into the U.S. from Canada.
According to the Canadian National Post more than 60,000 Kinder Surprise eggs were confiscated at the U.S. border, and heavy fines are implemented starting at $300 to $2500 per egg.
A lady from Winnipeg tried to cross the U.S. Canadian border with this product and she was penalized $300, and her egg seized because it is illegal in the U.S.
The Kinder Surprise egg banned since 1938 when the Food and Drug Administration (FDA) passed the Food Drug and Cosmetic Act, which prohibits non-nutritive items to be in a confectionery product.
The co-founder Kevin Gass of Candy Treasure LLC, of Lebanon, N.J. is a business man that loves this chocolate surprise egg. His determination to create a similar Kinder egg that could be non-hazardous made the contraband legal in the U.S.
Gass worked with the FDA, and the U.S. Consumer Product Safety Commission to make Choco Treasure safe for children and adults.
Kinder Surprise egg manufactured by an Italian company called Ferrero. The chocolate eggs produced by Ferrero is not safe for children under the age of three according to the FDA.
Gass had two challenges he had to overcome creating Choco Treasure. Safety was a key factor for all who would buy this product, and a toy that would appeal to both young and old.
Gass stated “young kids love sticker; adults do not want stickers.” So Gass and his team came up with three options that would be something for everyone, a mini deck of cards all 52 cards, a tiny 3-D puzzle and a tiny little rubber squirty toy.
The Choco Treasure egg, is now legal in the U.S., and can be purchased on the Choco Treasure website, and other local retail stores. The cost for Choco Treasure will be from $1 and $1.49.
