My ex-boyfriend and the father of my baby told me that if I apply for child support I will not get anything because he doesn't have a job or any money, but if I don't file he will try to help me? That makes no sense. If he doesn't have income then how could I get child support from him? And if I don't file, how is he going to help me? I would rather do it through the courts because he has a bad temper and when I will need money he will always give me a hard to time. My son has to eat and needs diapers and we need a home. My boyfriend has to have money, because he does trading options.What do I do? Please help me.

Dear Hopeless:
Stop giving him all the power in the relationship, and file for child support anyway! His manipulative behavior and attempts to control you for his personal gain is nothing but emotional abuse. The San Francisco District Attorney's office handle child support prosecution, and they do not play. Sit back, cross your legs, and let the power of the court work for you.
The courts have the right to subpoena his bank records, tax documentation, checking and savings account information, and go through his financial records with a fine tooth comb. It's obvious that he has income and assets, becasue he is hardly starving nor is he homeless.
The court does not care if you don't have a JOB. If you have money invested you have to give some to your kids. If you are getting unemployment or workers comp you have to give some to your kids. If you are living off of a trust fund, you have to give some to your kids. The State of California will snatch his tax return if need be and give it to you for the kids. Some states, including California, revoke drivers licenses and put men in jail that don't pay their child support.
There are plenty of reasons he should start paying because he won't like the options.
Do not let him intimidate you into not filing child support. Plus that is the only way to get a court order so that if he comes into a chunk of money in the future, you will get some for your children. The City and County of San Francisco has established a child support services website which enables you to file the initial case online. Do not tell him that you plan to do it or that you are going to... just do it. He'll find out when they serve him.
You can use this handy calculator to get an idea of how much child support you may be entitled to. The City and County of San Francisco uses a set formula from which there is no deviation. He is going to be very sorry that he played this silly game.
Remember, you owe him no explanations. Stop telling him everything you do and just do it. Women generally talk too much and tell too much of their business to men. Be cagey, and be quiet. Do what you need to do for your babies and screw him.
