The Cherokee child, who is the four-year-old girl known as “Baby Veronica," has been handed over to her adopted parents, confirms the Cherokee Nation this week. A South Carolina couple, Matt and Melanie Capobianco, the adopted parents of baby Veronica, went to Oklahoma and vowed not to leave until their daughter came home with them. Well they got their wish, reports CBS News on Sept. 24.
The Oklahoma Supreme Court said they did not have jurisdiction over the child, so they had to dissolve a temporary court order that originally granted temporary custody to the child’s biological father, Dusten Brown, and his family. Since the court had no jurisdiction over baby Veronica, the court order wasn’t legally binding.
It is not known why the Oklahoma court changed their ruling putting Baby Veronica's fate in the hands of the Cherokee Nation. The Cherokee Nation insisted that the child remain with the tribe and they too got their wish, they now have a say in the little girl's fate and they put her in the arms of her adoptive parents.
The fight for custody between the adoptive parents of baby Veronica and her biological father has gone on for years in court. The father of the girl gave up any rights to his child before she was born, but he didn’t know of the mother’s plans of giving the child up for adoption, he claimed.
While he gave up his rights as a father, he thought he would still be part of her life. When finding out that his daughter was given up for adoption, he set the wheels in motion to try and get her back. He was given custody of Veronica when she was 27-months-old.
The adoptive parents were ordered to hand over the child to the biological father, which they did. Monday’s ruling put baby Veronica back in their arms after a long struggle. The Cherokee Nation has jurisdiction over the child because her father, Brown is Native American.
With the Cherokee Nation giving custody of the child to the adoptive parents, they were acting on the part of the child. They placed her in the home where they feel she will best flourish. This strange turn of events has finally reunited Veronica with her family, the one she's known since birth.
