Bolingbrook police say the Will County State's Attorney had approved a charge of reckless homicide/.08 alcohol against Luis V. Benito. The passenger in the vehicle was released without being charged.

Police say a teen driver may have been drunk when he crashed an SUV through a Bolingbrook apartment early this morning, killing a woman in her bed.
Police have arrested the driver, Luis Benito, 17, of Bolingbrook. An unidentified passenger in his car was also arrested.
Bolingbrook Police Lt. Michael Rompa says that as of 2 p.m., no charges have been filed in the case.
Rompa says at around 2:15 this morning, Benito was driving a 2002 Chevrolet SUV through a common area of an apartment complex on 300 Woodcreek.
He allegedly lost control and the SUV crashed through the building with its front half landing on top of a woman who was sleeping in her bedroom in a basement apartment. Her husband, who was sleeping next to her, was not injured.
The passenger in the car jumped out and ran from the accident but was found quickly by officers responding to the scene, according to Rompa.
He says Benito fought with the officers when they tried to arrest him.
Josephina Prospero, 46, was killed in the accident. Her husband, Juan Nicholas, was taken to a hospital as a precaution but was released when it was determined he was not seriously injured.
