CBS airs Constitutional law professor: 'Let's give up on the Constitution'

On Sunday morning, CBS aired a commentary by Louis Michael Seidman, Professor of Constitutional Law at Georgetown University, in which he advocated giving up on the Constitution.

Echoing sentiments he expressed in an op-ed at the New York Times in late December, Seidman said that Americans should not allow the country to be governed by a document that was written by "people who died over two centuries ago and knew nothing of our country as it exists today."

"I've got a simple idea," he began. "Let's give up on the Constitution."

"I know, it sounds radical," he added, "but it's really not. Constitutional disobedience is as American as apple pie."

Seidman went on to say that while the Constitution has many things in it that are "important and inspiring," the document "contains some provisions that are not so inspiring," like the electoral college.

In December, however, he used much stronger language, calling parts of the Constitution "archaic" and "evil." He didn't use those words on Sunday, however. Nor did he reiterate his belief that adherence to the Constitution amounted to bondage, as he did in his op-ed.

He turned his attention to the thorny issue of gun control.

"None of my friends can believe it, but I happen to be skeptical of most forms of gun control," he said, while recognizing that not everyone agrees with him.

Nevertheless, he bemoaned the fact that those who argue the issue often turn to the men who wrote the Constitution.

"So instead of talking about whether gun control makes sense in our country, we talk about what people thought of it two centuries ago," he added.

Certainly, the original intent of the writers is an important aspect of the debate, but Seidman says that should be ignored.

He went on to call the Constitution "outdated," implying that the document that has governed this country for over two centuries is no longer applicable.

"If we are to take back our own country, we have to start making decisions for ourselves, and stop deferring to an ancient and outdated document," he concluded.
