A Catholic, Staten Island mom in West Brighton, New York is suing the Department of Education after it rejected her 5-year-old daughter's application for a religious vaccine exemption. In a lawsuit filed on Tuesday in Brooklyn Federal Court, Dina Check alleges that the Education Department's denial is a slap at her beliefs and her First Amendment rights. Attorney Patricia Finn, a vaccine exemption and injury attorney and Check's lawyer, told DNAinfo.com New York that she thinks “...they made a mistake. The parents are entitled to the exemption.”
Check’s daughter was not allowed to attend class on Tuesday at P.S. 35 The Clove Valley School after officials denied her initial request and her later exemption appeals. The lawsuit says that the little girl had been granted an exemption the previous two years when she attended a YMCA education program. In her exemption request to school officials, Check described herself as a Bible-reading, church-going Catholic. Check says that her daughter suffers from gastrointestinal problems and that this also qualifies her for a medical vaccine exemption.
The number of parents opting out of vaccinations has risen in popularity. A 2011 Associated Press report found that more than half of U.S. states have had slight rises in the rate of exemptions in the past five years. Attorney Patricia Finn's firm has represented hundreds of families in exemption fights. The lawsuit seeks an exemption on religious grounds but Finn is also seeking a temporary restraining order allowing the little girl to attend school.
