Boston University junior defenseman Max Nicastro was arraigned on two counts of rape Tuesday in Brighton District Court (Massachusetts) with a plea of not guilty automatically entered on Nicastro’s behalf according to a report by ESPN. Nicastro is due back in court on March 26 for a probable cause hearing.
Judge Franco Gobourne ordered Nicastro held on $10,000 cash bail and issued a no-contact order. According to EHow.com, a no-contact order prohibits somebody from being in physical or telephone contact with somebody else. In most cases, the court must specifically express the distance the restrained party must keep from the other. Usually the distance is a matter of feet or yards in as much as courts are limited as to restricting the physical freedom of non-detained individuals (those who are not in jail). It's often used in separation and divorce proceedings.
Nicastro’s attorney, Hugh Curran, said that Nicastro had planned to stay at BU to complete his degree in business administration, including taking classes this summer. In an update to this story and according to a Boston University spokesman, Nicastro is no longer enrolled at BU.
Nicastro had nine points in 26 games for the Terriers this season before being suspended from the team pending the result of the police investigation.
