This story has been slipping under the Main Stream Media Radar for some time now.
U.S. Army Major Stefan Frederick Cook Filed a restraining order asking for legitimate confirmation that his Commander in Chief was legitimately in Office, giving him his orders to Deploy to Afghanistan with his unit.
Today in a stunning development, the Military rescinded those orders.
This has set a precedent heretofore unknown. The entire US Military can now not only question it's orders, a requirement of their duty when they believe that an order is given illegitimately, but can expect that their orders will also be rescinded should they question the legitimacy of the CIC who is the ultimate Authority in Command. In other words, Obama.
Orly Taitz, Major Cook’s lawyer filed the request for a temporary restraining order in U.S. District Court for the Middle District of Georgia asking the court to grant her client’s request for proof of Obama’s eligibility to serve as President of the United States.
Stating in her filing that cook “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties,” Ms Taitz has essentiality won her case as the military has ducked on the issue.
Ms Taitz is quoted by WND as saying: “"We won! We won before we even arrived," she said with excitement. "It means that the military has nothing to show for Obama. It means that the military has directly responded by saying Obama is illegitimate – and they cannot fight it. Therefore, they are revoking the order!"”
At first glance this may seem to have ended the case. However, it must be noted, that if Obama cannot legitimately give an order to deploy, then he cannot rescind the order either.
Things just got real interesting folks.

Your arguments do not make sense. Cook never disobeyed an order since the order was revoked. If some poorly informed military person decides to ignore a lawful order then claiming that the President is ineligible is a non-justiciable question and irrelevant to the order given.
Are you sure you want to doom military personnel to a court martial? Ask Michael New how successful they can be.

Almost. If the Military revokes orders for this, deployments are going to stop. It means on the face of it, that the Military cannot prove Obama's legitimacy. The Military is bound to follow the Constitutional CIC. If the CIC isn't capable of proving his Status.... yea that's a really big problem.
This is just the start, there will be ramifications to this, potentially big ones.

The Army may have something else in store or in mind for the Major.
Ms. Taitz argues too much. On the one hand she say's the only thing that has happened is that the orders are "revoked," nothing else. That is not an admission of the premise about the president's place of birth.
Will the Major be allowed to remain in the Reserves? Should he be discharged from the Reserves he will lose his retirement eligibility unless he has his 20-year letter.
So because as you point out -- there is a bigger picture here -- I would anticipate the Army has something else in mind to do with the Major.
I hope also that Ms. Taitz has offered to represent the major who will now have to deploy in place of Major Cook. Yes, that's the potential effect of his refusing to go -- someone else will be ordered to go in his place. Or the people there will have to work longer and harder because he's not there and there's no one else available to go.

He VOLUNTEERED for service, and his Motion filed in Federal Court by Orly and served on the Military served as his constructive notice that he no longer wanted to deploy--IN OTHER WORDS, IT EQUALS HIM ASKING TO HAVE HIS ORDERS REVOKED--so, his orders were revoked...that is all that happened.
Lt. Col. Maria Quon, U.S. Army Public Affairs Officer, U.S. Army Human Resources Command-St. Louis, said Tuesday evening Cook was no longer expected to report Wednesday to MacDill Air Force Base in Florida for mobilization to active duty.
On May 8, Cook submitted a formal written request to Human Resources Command-St. Louis volunteering to serve one year in Afghanistan with Special Operations Command, U.S. Army Central Command, beginning July 15, Quon said.
The soldier’s orders were issued on June 9.
“A reserve soldier who volunteers for an active duty tour may ask for a revocation of orders up until the day he is scheduled to report for active duty,” Quon said.
What he has done is nothing to be proud of...so, he VOLUNTEERED for deployment, then he changed his mind. He is a coward and a fool and his Military career is now over. Obama is the Commander in Chief. Period. Get over it.

Major Cook revealed his hostile, paranoid mental state to the Army, and they wisely concluded he would be a danger to his unit and a liability to operations in Afghanistan, so they rescinded his deployment.
No legitimate lawyer (in fact, no reasonable person of any kind) would publicly conclude from the Army's decision that "the military has directly responded by SAYING Obama is illegitimate," when the military said no such thing, by even the most tortured stretch of the facts in evidence.

Tait overstated the meaning of the revocation of the order. But the fact remains, she got the relief her client wanted. And, now, anyone who wants to get out of a deployment (or any other order) can make the same objection. Eventually the Army will have to confront the issue. The fact that they did not confront it hear was not a good sign for the CIC. They may have been buying time. Who knows.

Cook, a reservist, VOLUNTEERED for the tour in May of this year, when Obama had already been in office for months. Why did it escape him then that his CiC was "illegitimate?"

There is no indication that the reservist needs to supply a REASON for the request, or that the Army is required to AGREE with any reason given by that reservist for changing his mind, nor is there any evidence that the reason stated by his lawyer was even communicated to the Army in his request for revocation of the deployment orders HE HIMSELF APPLIED FOR.

Everyone aknowledges that their shoud be another certificate called the long form. This is what all us crazy people are asking for. Military personnel take an oath to protect and defend the Constitution of the United States. It is not their right but their duty to question and/or refuse an unlawful order. As I see it the order for the Major to deploy is unlawful because Mr. Obama is not legally the commander-in-chief.
Mr. McMullen, I do not think it wise to say so boldy what you can not know. I for one say that I don't know if Obama is legit, but I do think we the people deserve to know. The only reason I am saying this is because the folks who do not want Obama questioned at all on this matter tend to speak in the same authoritarian tones. We should all asking questions about this, but when we make statements of facts, we should also be prepared to back them up.
No long form birth certificate, no hospital or delivery physician listed. The father's race is listed as "African". Just what race is "African"? Would that be an arab-african from North Africa? Or would that be a white dutch-english african from South Africa?
That is a politically correct description created in the 1980's as the term "african" or "african-American" was not used in 1961. The term black or negro was used.

The military is not in the habit of resending lawful orders. I don't know what it is, but something is wrong here. Americans have a right to know if or if not Obama was legally born an American citizen. Perhaps some Red state will pass a law requiring a "long form" birth certificate be filed to place a candidate on the presidential ballot in 2012.

This case is a total fraud. He volunteered to be a plaintiff. He volunteered!
He was a reservist. He volunteered to serve in Afghanistan. He could have revoked his voluntary decision at any time before reporting. He boasted in advance that he would do this so that he could sue.
The Army apparently decided correctly that he was unfit to wear the uniform of a US Army Officer and unfit to serve in the military. They refused to accept his “volunteering” for service.
This does not make a voluntary military BECAUSE HE WAS NEVER ON ACTIVE DUTY IN THE MILITARY. He was never even ordered by the President or anyone else to report for duty. He was a civilian at all times. He was free to decline to serve at all times.
The President never ordered him to serve. The President never had to revoke an order to serve.

Obama has provided a valid birth certificate. The Certification of Live Birth is now the official birth certificate of Hawaii. (This site will now allow a link to the URL, but it is in the Star Bulletin Newspaper of Hawaii on June 6 of this year, and the article has the headline Born identity.)
And as the above cited article says, it is the only birth record that Hawaii currently sends out.
This being the case, unless Obama has kept a copy of the original and not lost it (and many of us do lose our original birth certficate), all that he can show is the only document that Hawaii sent to him, and it sends out only the Certification.

Vince you should clarify your post or research our military a little better. All branches of our military are made from volunteers. According to your post it sounds like any soldier at any time could decide to stop volunteering. It doesn't work that way.
smrstrauss is right. Applicants can no longer get so-called long forms or vault copies of their birth records. The Certification of Live Birth is the only form issued to anyone. There is no other form Obama can produce.
He has fully complied with the pending bill that requires candidates to provide a birth certificate.

Cook was never sworn in. He was never on active duty. If he had reported and taken the oath, then he would have been bound. But he never did. AND HE WAS NEVER OBLIGED TO SO. He could revoke his voluntary offer at any time.

Sorry Vince, but you are incorrect. Upon graduation of basic training all enlisted personel take the oath of whichever branch they are in. They are no longer civilians.

According to the court filing, Cook affirmed when he joined the military, he took the following oath: "I, Stefan Frederick Cook, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the president of the United States and the orders of the officers appointed over me, according to the regulations and the Uniform Code of Military Justice. So help me God."

If there is nothing to hide, Obama should have no problem letting the court examine his birth certificate to confirm that it is valid, legal, and authentic.
If Obama does not do this, then he definitely has something to hide.
Major Cook is supposed to take orders fron the Commander and Chief. If Obama is not a natural born US citizen---then he is NOT qualified to be President, and he is DEFINITELy not qualified to give orders to our military.
