Gai Scott was arraigned in for the shooting of his uncle Raymond "Benzino" Scott. Gai plead not guilty to charges of assault and battery with a deadly weapon and armed assault with intent to murder. According to the Patriot Ledger on Tuesday, Gai Scott is being held without bail.
The 36-year old is accused of shooting his uncle during the funeral procession for Benzino's mother. Gai Scott insists the shooting was self defense and that he only fired shots after Benzino threatened him. The two were travelling in separate cars during the funeral procession along Route 3 in Duxbury.
Gai Scott was able to meet with his newly hired defense attorney just before meeting with the judge. Rosemary Scapicchio asked the judge for more time so she can gather witnesses including Ray Benzino Scott for a dangerousness hearing. This will determine if Gai Scott can be freed on bail or if he'll stay behind bars until trial.
According to Plymouth County Assistant District Attorney Thomas Flanagan, Raymond Scott already gave sworn testimony regarding the case against Gai Scott. He argued that since Scott lives and works in Atlanta, he should not be required to come back and testify in what amounts to a bail hearing for his nephew.
Gai Scott is scheduled to be back in court on June 23 for the dangerousness hearing. At that time, the judge will determine if bail will be set or if he will be held for another 90 days without bail. The district attorney's office argues that Gai Scott has confessed repeatedly to being the gunman. That issue isn't even in question but Gai Scott contends it was self defense and the prosecutors argue that there is no way.
The defense argues that "Love & Hip Hop Atlanta" star Benzino made threats to the nephew and other family members just prior to his mother's funeral. His niece is even said to have taken out a restraining order on her uncle because of things he said.
