Over a year later, and the news about James Holmes and the Aurora shooting at a showing of "The Dark Knight Rises" has still not ended. According to 9News on Oct. 23, 2013, word is going about now about the different items that were seized from Holmes' apartment and whether they can be used or not at his 2014 trial. One of those items happened to be a Batman mask.
Revealed at a pretrial hearing, there were a number of other items revealed to have been found at Holmes' apartment.
Some of those things include:
- The Batman mask
- A "violent" drawing
- The day of the attack marked "with a unique symbol" - The symbol was not described
No testimony was given regarding the significance of the items. Holmes' attorneys have already acknowledged that their client was the gunman at the shooting, he has pleaded not guilty by reason of insanity to murder and the related charges.
Prosecutors will have to prove at the trial that Holmes was sane during the attack and are seeking the death penalty. Most of the items being contested during this month's hearings could be used by prosecutors to try and see through the insanity plea.
Other evidence that will come about during the pretrial hearings includes statements made by Holmes after his arrest and computer and bank records that police have said document the purchases of weapons and explosives that he made.
