DNA tests confirm that the body parts found last week near New York’s East River belong to missing teen Avonte Oquendo, according to a Jan. 21, 2014 CBS NY report.

Julie Bolcer, a spokesperson with the Office of the Chief Medical Examiner announced, “The remains that were recovered in Queens were those of Avonte Oquendo… The cause of death and manner are pending further studies,” reports the New York Post.

When the remains were discovered on Jan. 16, authorities had suspicions they belonged to Avonte because clothes found nearby matched what the teen had been wearing when he vanished.

On Monday, the family’s lawyer, David Perecman, expressed concern over the fact that a large pair of Fruit of the Loom underwear was found on the body because Avonte only wore Hanes and not size “large.”

He told the Post, “…what that indicates to me is that something happened… Someone got a hold of him, moved him. I can’t say they harmed him, but why would the underwear have gotten changed?” Perecman noted.

Avonte reportedly left his school on Oct. 4, 2013, and was last seen on surveillance footage that same day walking toward a park on the East River.

CBS NY reports that the boy’s family has filed a notice of claim saying they plan to sue the city, arguing the school allowed Avonte to exit the facility and then did not notify police immediately that he was missing.
