Aurora shooting suspect James Holmes may be given 'truth serum'

The Guardian from the UK reports today a judge ruling that suspected Aurora, Colorado movie theater shooter James Holmes may be administered a “truth serum” if he pleads not guilty by reason of insanity. Holmes is charged in the shooting incident at an Aurora, Colorado movie theater in which he allegedly killed 12 and wounded another 50 individuals. Holmes, who was initially falsely identified as a member of a local Tea Party group, turns out to have had past ties with the leftist Occupy movement.

The Guardian article sums up the notion of giving Holmes a “truth serum” with this: “Judge William Sylvester ruled that in the event of Holmes pleading insanity his prosecutors would be permitted to interrogate him while he is under the influence of a medical drug designed to loosen him up and get him to talk. The idea would be that such a "narcoanalytic interview" would be used to confirm whether or not he had been legally insane when he embarked on his shooting spree on 20 July last year.”

It is highly unusual for a court to use a “truth serum” to get a defendant to testify or tell the “truth” about involvement in an alleged crime. Courts have almost never used this in the past and medical experts doubt it would be very effective.

The article quoted Steven Hoge, a clinical professor of psychiatry at Columbia University in New York, as saying there is, "no great evidence to support that narcoanalytic interviews lead to the truth by any means.”
