Attorney Viets' petition undermines the Hancock Amendment

On Tuesday, December 10th, 2013 Attorney Dan Viets of Columbia, Missouri filled 10 ballot initiatives on behalf of Show-Me Cannabis Regulation SMCR with Missouri Secretary of State that does two things:

  2. Amend section 18(e) of Chapter 10 of Missouri constitution known as the Hancock Amendment.

The Hancock Amendment is a major piece of legislation that limits Missouri government. Author Republican State Representative Mel Hancock served 1989 to 1997 led a successfull petition drive to require voter approval at state and municipal level to increase taxes has been inducted to Missouri Hall of Fame. Democrats, progressives and big government supporters have been attempting to repeal or amend the Hancock Amendment and with Viets petitions they may have sneaky way found a way to it.

Two sections of the Viets petition allows for raising taxes without voter approval. Section 6 clause 7 allows the legislature to impose an excise tax between 15% and 30% of purchase without voter approval. It reads:

…nor subject to additional voter approval under section 18(e) of article X of this constitution.

and 13 Reads:

The general assembly may enact laws the control, regulate, and tax the manufacture, production, and delivery of industrial hemp.

13 like section 6 clause 7 allow taxing without voter approval. Some voters will go into the polling booth thinking they're only voting to legalize marijuana unknowingly they're voting amendment the Hancock amendment. Marijuana will be legal if Viets has his way, but marijuana will be the only product that can be taxed without voter approval. Viets effort, shall he be successful, could lead to a gradual full repeal of the Hancock Amendment.

SMCR have paid Viets for services from time to and currently have a little over $600.00 on hand. SMRC funding comes from America Victory Coalition out of Portland Oregon. American Victory Fund advocate for marriage equality, reproductive rights and other progressive issue unrelated to legalizing marijuana along with advocating legalizing marijuana.
