Animal Care Services (ACS) of San Antonio, TX has operated a “temporary” facility for approximately 3 years. During that time, they have claimed they could not allow public access because it would violate their lease agreement with the Brooks Development Authority (BDA).
However, it appears that ACS Director Kathy Davis and other city representatives are more than willing to violate the lease when it is to their liking. Moreover, the losses of lives of many animals that have gone unseen in the severely restricted facility seem to have been of little concern to Davis.

According to the current lease agreement with the Brooks Development Authority, ACS is required to obtain "prior written approval of Landlord as to the design and installation of all improvements."
Through Open Records Requests to ACS and the BDA, it is found that no such approval was submitted or obtained by ACS.
Additionally, Davis claimed repeatedly for many months that Brooks would definitely be converted to a quarantine facility. She did not state it was something they wished to do; she spoke of it as a certainty. Again, there was no approval from the San Antonio City Council or the Brooks Development Authority for this change of use. Even the decision by City Council to renew or deny the renewal of the lease is also yet to be made.
However, taxpayer money for construction was invested recently prior to approval of the conversion to change to quarantine, and Davis continues in her deception to the public.
Funds have been misappropriated in the past, false claims are made, taxpayers’ rights and municipal code are violated repeatedly, yet nothing is done to stop the unlawful actions and deceptive practices by the city’s Animal Care Service. The open disregard for proper and lawful use of taxpayers’ money continues unabated, while the main-stream media and city representatives continue to promote the “success” in questionable and controversial live release rates of ACS.
