Amber Yust Update: DMV clerk resigns after harassing transgender woman

The California Department of Motor Vehicles clerk accused of harassing Amber Yust has resigned.  DMV spokesman Mike Marando reports that the DMV received a resignation letter submitted by Thomas Demartini late Wednesday.

Thomas Demartini, a San Francisco DMV employee, mailed Yurst, a transgender woman, a harassing letter quoting the Bible, calling her choice to transition to female evil, and threatening her with damnation.

Thursday CNN reported that Yust is asking for a temporary restraining order against Demartini. Earlier this month Yust filed a formal complaint with the California Department of Motor Vehicles in San Francisco concerning Demartini's actions.

Demartini came into contact with Yust last October while processing Yust's name change request in his capacity as an employee of the DMV. After assisting 23 year old Yust, Demartini used her personal contact information to send a letter to her home condemning her gender identity.

In the letter Demartini wrote:

"Although I helped you with the name change, I have to say I do not support the reason for it. I also do not believe the state's recognition of it—through official documents—makes it legitimate or any less evil."

In the letter Demartini went on to call Yust an "abomination," said she made a "very evil decision," and that "the homosexual act is an abomination that leads to hell."

In addition to the letter, a DVD arrived from a fundamentalist church warning of eternal damnation for anyone "possessed by demons" of homosexuality. Demartini's letter had referred Yust to the church's website as a source of "critical information for your salvation."

What makes matters even worse is that the DMV had received previous complaints about Demartini's on the job insensitivity and religious bigotry.
