I don't believe the faulty brake is the cause. I think Mr. Yan stepped on the gas paddle instead of the brake. Just like the fella who killed many people at the outdoor market many years ago.

First of all, it is highly unlikely that the brakes in this 2005 SUV were "bad" as is stated in the previous comment. Moreover, I'm quite certain that human error related to traffic conditions, along with the gentleman's age, are significant factors of this tragedy.(it is rather amazing none of the children lost there life) Mr Yan's troubles have just begun, If the pain and misery of "fault" does not give him a heart attack at his age, It is highly probable that the onslaught of lawsuits, most likely will... Mr Yan will never drive in this country again, short of that, please tell me what purpose it serves to put this man in jail. I'm not sympathetic toward Mr Yan, however our rush to punish should be looked at from a more objective position. It's a terrible incident, but the parents directly involved should find reason to be thankful their children are still with them. It could have been much more painful. I have three kids of my own.

He needs to be arrested! If he knew the brakes were bad he should have never driven that vehicle in the frist place. He deserves to be arrested for injuring all those childhren. This is what happens when you don't pay attention to what you are doing. You don't do that and think you can get away with it. Moments before that my niece was there and for some strange reason she went to the other end of the school were I finally found her. The children need a lot of support and love right now from everyone right now. My heart goes out to the children.
