Barry’s Magic Shop has struck a deal with Montgomery County and likely will reopen in Rockville this summer, one year after the famed local store started receiving eviction threats.

County Executive Ike Leggett announced the agreement Wednesday from the planned future site of the 30-plus-year-old business, 5544 Nicholson Lane in southern Rockville.

Formerly, Barry’s was located along Georgia Avenue in the heart of Wheaton’s business district. Problems arose from the desire by county leaders to replace the popular business with a pedestrian walkway they said was planned for decades.

Now, after a lengthy legal battle and much public outcry, the two entities worked out a new setup that Leggett said worked for everyone.

“Our objective has always been to create a more vibrant, walkable downtown area,” he said of the redevelopment of downtown Wheaton. “However, as part of this process, it was important to respect and protect the interests of businesses, such as Barry’s Magic Shop.”

The terms of the settlement stipulate that Montgomery County will pay $260,000 in relocation and settlement fees to Barry’s management. In return, the Wheaton property, which the county purchased last summer, must be vacated by June 30.

Barry and Susie Taylor, owners of Barry’s Magic Shop, indicated their appreciation for Leggett’s help in finding the new business locale, saying in a written statement that they hoped to stay in Wheaton through next month and then have a grand reopening in Rockville in the summer.

“Our new store will be bigger and better, and we look forward to sharing our love of magic with children and adults in this new space,” Barry Taylor said.
