A Cobb County police officer who is accused dealing an illegal poker game in Smyrna has resigned.

Police said 33-year-old officer Christopher Soltes resigned Wednesday after being arrested at the illegal game Tuesday night. He and the 42-year-old homeowner Paul Miller were charged with commercial gambling, which is a felony.

Miller also was charged with keeping a gambling place and gambling, which are misdemeanors.

Agents from the Organized Crime Intelligence Unit raided the Texas Hold'em game after an undercover officer posed as a player Tuesday night.

Five others who were playing poker there will face misdemeanor gambling charges.

The investigation began after neighbors complained about a lot of activity at the house.

Soltes and Miller each was released on $5,000 bond. Soltes had served in the department since 2001.
