A plea deal for a 9-year-old eastern Arizona boy who had been charged with killing his father and another man could be in jeopardy.

Apache County Attorney Michael Whiting and the boy's attorney want a new judge in the case because the current judge is questioning a treatment requirement. The plea guaranteed the boy wouldn't spend any time in the state juvenile corrections facility.

But the judge says he doesn't think he can order the boy into an out-of-state treatment program and might be forced to send him to a state juvenile jail instead.

The case is on hold until a second judge reviews the request to replace the current judge.

The deal allowed the boy to plead guilty to negligent homicide in the shooting death of his father's friend and dropped the charge for the father's death.
