Montgomery County police plan to charge a Virginia Beach man in a June 16 hate crime, Lt. Eric Burnett said Thursday.

Burnett said Richard Maxino, 35, of the 700 block of Virginia Dare Drive in Virginia Beach, was found standing near his vehicle by the victim’s driveway, located in the 9300 block of Harvey Road in the Indian Springs section of Silver Spring, at about 1:15 a.m. When the victim attempted to confront him, Maxino got in his vehicle and attempted to run him over, according to police reports.

In the process, Maxino, who Burnett described as a white man of Latino origin, dropped a threatening note containing racial slurs describing the victim, police said.

The victim, a black man who Burnett would not identify, jumped out of the vehicle’s path and Maxino reportedly yelled ethnic slurs at him, according to police reports.

Maxino was a former neighbor of the victim who moved away three years ago, Burnett said. He did not know why Maxino returned to the area but said the two men had disagreements in the past.

“He was in this man’s driveway and he was going to do something, obviously,” Burnett said. “I don’t know what happened to make this guy come back or if he was just in the neighborhood passing through.”

Maxino, who was being held in Virginia pending extradition to Montgomery County, will be charged with first- and second-degree assault and race/religious harassment of a person, Burnett said.
