The seven justices unanimously agreed that the Virginia Constitution contains “self-executing” provisions that automatically waive sovereign immunity in constitutional cases. This means two lawsuits relating to Dulles Rail now have to be heard in Richmond Circuit Court on their merits.
And those merits are considerable indeed. Fairfax County residents and Dulles Toll Road commuters Patrick Gray and James Nagle object to Gov. Tim Kaine’s transfer of the toll road, a state asset paid for by local taxpayers like them, to the unelected board of the Metropolitan Washington Airports Authority without the General Assembly’s approval. Richmond lawyer Pat McSweeney — who filed both lawsuits — told The Examiner that Kaine’s unilateral transfer violates the state constitution’s separation of powers doctrine.
There are also unresolved issues raised in McSweeney’s successful lawsuit on behalf of Del. Robert Marshall. When the high court invalidated the taxing powers granted by the legislature to the similarly unelected board of the Northern Virginia Transportation Authority, it did not address the sale of $3 billion worth of transportation bonds to finance various projects, including Dulles Rail. McSweeney persuasively argues that such debt is unconstitutional unless voters first approve it in a referendum. And so far, he’s batting 2 for 2.
The General Assembly has been skirting this constitutional requirement since 1991 by calling them “subject to appropriation bonds” — implying they are somehow not legally enforceable debt, even though the state law authorizing them specifically refers to them as negotiable securities. Thanks to last week’s sovereign immunity ruling, the lower court will now be forced to address this inherent contradiction.
Taken together, both rulings represent a significant constitutional victory for all Virginians, though certainly not a final one for local commuters still stuck with the entire state share of the Dulles Rail boondoggle with no redress at the ballot box. But the high court shocked Richmond once again by sending a timely reminder to both the governor and the legislature: You work for the citizens, not the other way around.

This corruption of the CPS system is happening across the country and something has got to be done to stop it. There needs to be laws that hold social workers and the entire health and human services department liable when they behave like this. These workers will forge documents, falsify records, commit perjury, lie, break statutory law, violate welfare policy in order to take children who do not need to be removed, all the while leaving children who do need to be removed to die in their homes. Criminal liability needs to occur here and until it does, until these people are charged and prosecuted for the crimes that they are committing this behavior will continue. Write your legislature, new stations anyone and everyone calling for accountablity of the CPS system. The problem is, the Anchorage anecdote just highlights the idea that the editorial writer has already made up her mind about climate change, using extremely weak statistical analysis and talking points in place of sturdier scientific inquiry. Every week or so, Barbara Hollingsworth cherry picks these lousy talking points and dumps them into her editorials, embarassing this publication in the process. Maybe these editors should stop drinking the contrarian Kool-Aid on this issue. YOU are the journalists. DO THE RESEARCH! I'm not being paid to do it for you, so why is your data so easily refuted by the most superficial analysis I can stand to post on these comment boards?

Maybe you need to get out of the kool-aid pitcher and look for it. Annual temperatures have been trending cooler over the last decade. By the way, 1934 was the warmest year 'on record' and since then we've had cooler periods and we've had warmer periods. Climate temperatures fluctuate and in actuality we're heading back into a cooling period. www.icecap.us

If you had avoided the Anchroage anecdote, this editorial might have amounted to something. Unfortunately, you lead off your argument with a horribly limited data point that disproves nothing. So anchorage is having fewer hot summer days. Is the annual average higher than normal? Are the annual temperatures trending hotter over the past few decades? You could just as easily have pointed to a city in the Northern Hemisphere that is having one of its hottest summers ever. More sloppy statistical analysis; a high-school course could poke more holes in it.
