A D.C. Superior Court jury found Hernan Melendez, 17, guilty of second-degree murder, assault with a dangerous weapon and possession of a prohibited weapon.
Melendez, of Honduras, faces more than 50 years in prison but will likely be sentenced to between 13 1/2 years and 29 years under sentencing guidelines.
At about 2 a.m. Jan. 28, 2007, Melendez and two friends got into an argument with Andres Benitez near the Old Ebbitt Grill where Benitez worked as a dishwasher, prosecutors said.
Benitez retrieved a baseball bat and swung at the group, but the three men rushed him to the ground and started kicking him.
As Benitez lay on the ground, Melendez grabbed the bat and hit Benitez as many as 10 times until a bystander tried to break things up, authorities said.
Melendez struck the Good Samaritan in the head and resumed his attack on Benitez, pounding him five more times, authorities said.
Two security guards who witnessed the attack chased Melendez and caught up to him at a nearby apartment building. Melendez still had the bat in his hand, court documents said.
Benitez died at the scene. His skull was crushed.
Authorities said Melendez was in the country illegally. He told authorities that he had only been in the area eight days at the time of the incident. Melendez had unlawfully entered the United States twice in 2003 and had been deported each time.
Benitez was from El Salvador. In light of his death, his immigration status was never established, authorities said.
After initially telling authorities that he was 21, Melendez then asserted that he was 16 and challenged the propriety of being charged with murder as an adult. The challenges were eventually rejected by the court.

We have got to purge these violent bastards from this nation by purging the politicians who continue to support and therefore, enable illegal immigration. Vote out every single one of them, or lose your nation. It is that simple.

I find it interesting that this illegal alien who is under 18 was able to be deported 2 times and then reenter so that he was able to commit this homicide, and he was savvy enough with our laws to point out the issues he had with his charges being brought against him. He knows to say that he is a juvenile, he knows to express this issue to the authorities. Why do these people feel that the laws of the land should protect him now but has shown that he has no respect for our laws he finds don't fit with his use. I don't care who started this fight. He is the one who can't manage to stay out of trouble while he is here. It is our right as citizens to deny access to our country to violent criminals. The government has an obligation to protect us from people like this. We shouldn't have to wait for someone to kill. These people need to be caught before their presence becomes a problem.

INACCURATE -- Murder happened at 1227 11th Street NW. Scott, was that an honest mistake or did the story just seem more exiting if he was killed a block from the White House? You should correct it on the website at least.

Well, the gutless liberal Democrats want to see this country full of criminals, drug dealers and illegals to murder and rape. This is just a drop in the bucket compared to what we will see in the future. I had 6 uncles on both sides of my family who fought in WWII and 5 of them have told me the same thing---if we had joined the Germans instead of fighting them, this country would not be in the shape it's in.

These (ICE) sweeps are a provision enacted in the 1986 Simpson/Mazzoli bill, when the first AMNESTY became law. Since then an invasion has taken place, estimates of between 15 to 38 million aliens illegally settling here. Ted Kennedy promised no more AMNESTIES, but American fell in to a false state of trusting our politicians who have tried several times to bring us another abomination immigration law. We have seen very limited arrest and imprisonment from the aftermath of (ICE) raids. Pariah employers in corporate farms and general businesses, have not seen the interior walls of prison. Obviously we must relieve America of criminal aliens, but also anybody who flaunts the (IRCA) law. We must insist Democrats endorse the Federal SAVE ACT(H.R.4088), by phoning (2022243121) There leaders are keeping it dormant, waiting for the new presidents AMNESTY. Except that on its enactment millions more will pour across our border. The millions here already will be dwarfed in comparison.

Literally, this restaurant is RIGHT ACROSS THE STREET from the White House grounds. Every evening this area is swamped by the elite D.C. crowd. This is just ANOTHER example of how being pro-illegal alien is actually anti-immigrant. LEGAL immigrants do not support amnesty, open-borders, guestworkers, alien drivers licenses, sanctuary policies, etc.

I'm surprised that they even reported this crime since DC is the largest Sanctuary City in the nation. Special thanks go out to ex-police Charles Ramsey who gave a special order to his men. He believed that his men had better things to do than detain illegal aliens. Even though this is the Nations Capitol and homeland is top priority. That stabbing on the Mall last week was by illegal aliens.

An illegal alien, committing yet another violent crime, challenges the propriety of being charged with murder as an adult? Wonder if it was LaRaza, MECha, LULAC, or the ACLU that so quickly educated an illegal criminal on U.S. laws?
