Eddie House canceled his garbage-collection service, saying he doesn’t produce much trash. Now, San Carlos has sued him, saying the city the has a municipal code that requires all residential, commercial and industrial properties to contract with Allied Waste for pickup at least once a week.

SAN CARLOS (Map, News) - A man who claims to have reduced his waste to nearly nothing out of concern for the environment now faces a lawsuit from San Carlos for canceling his garbage-collection service.

Eddie House, 53, says he was shocked when he was served with a lawsuit Sunday at his Cedar Street home.

The lawsuit, filed by San Carlos Deputy City Attorney Linda Noeske in San Mateo Superior Court on Jan. 22, seeks a permanent injunction forcing House to maintain garbage service. City officials are also seeking to recoup from House the costs of the lawsuit.

The lawsuit claims House broke the city’s municipal code requiring all residential, commercial and industrial properties to contract with Allied Waste for pickup at least once a week — a standard requirement in most cities, San Carlos Deputy City Manager Brian Moura said.

House says he stopped his service with Allied Waste about a year ago after realizing that his garbage cans were nearly always empty.

“It’s just me and my dog, so I don’t have a whole lot of garbage to begin with and I recycle everything,” he said.

House recycles paper, metal and plastics, regularly hauling them in his pickup truck to a recycling center and collecting the refund, he said. What little backyard waste he generates is ground into powder by his wood chipper and food scraps are either pulverized by his garbage disposal or eaten by his dog. House’s larger items are either sold or given to people on Craigslist, he said.

“I don’t understand a city ordinance that requires you to fill up a can. That’s downright foolishness,” he said.

Moura said House’s lack of garbage service was brought to the attention of city officials after neighbors complained that House was causing foul smells by burning his garbage.

House acknowledges that the fire department was called to his house several times, but says that each time he was simply burning firewood.

House has made ongoing complaints to city officials over the apartment building next door, which he claims was built too close to his home and generates litter and parking problems. He said he fears that being sued by the city is retribution for being a “sore thumb.”

Moura denied the city’s action was personal.

“We don’t go out looking for these things. When the city does take code enforcement action, it’s usually something that’s brought to our attention by neighbors,” he said.

This does not suprise me, the mayor is guilty of fraud, the police was sued for 8 million and had to fire officers for the Bruce Hopkins ordeal. Their recycle program requires payment to dispose unwanted electronics that most likely end up for sale on craigslist, and they only except certain items. san carlos going green is only a title and paycheck for the relatives of city council members. san carlos has NO concern for the environment JUST GREED FOR THEIR POCKET BOOKS OF COUNCIL MEMBERS!

They cancelled my service, notified the City that I had failed to pay and I was criminally prosecuted. Three times in one year I was issued criminal citaions and criminally prosecuted (misdemeanor, 6 months in jail for each citation). Each time was over a billing dispute!!! Garbage companies that contract with Cities are wll aware that the citizens will be forced to contract through whatever court action. My choice, go to jail or pay the disputed overcharges!!!Monopolies, extortion, racketeering and a completely authorized dissolution of our Constitutional rights to be free from imprisonment for DEBT!!! Has this case been settled with Mr. House??

This man is NOT environmentally conscientious and trying to do right. He is a person who could care less about the children with asthma, the elderly with lung disease or anyone else for that matter. The reason the City even found out that he was burning trash was because SEVERAL neighbors complained that he was burning his trash. On a warm sunny day, we want to open our windows and smell the fresh air, NOT shut out all the toxic white smoke! We are furious with him. This is a selfish act with no regard to anyone but himself. Even though I agree that we should not be forced to pay for trash service if we don't need it, the conflict between Mr House and the city and community is much more than just about trash service. This is the talk of the town. The law suite is probably the only way the city can find to deal with someone who is a pain to the community. I live a few blocks down from Mr House and frequently walk past his house. I know his neighbors must be frustrated with him because his fireplace is constantly billowing thick smoke. I have no idea if he is burning garbage but for someone who claims to be environmentally friendly this is the worst air pollution imaginable! Even on warm sunny days the smoke is a real problem. Also, his front yard is usually covered with dog poop, so much that on warm days you can smell it from several houses down. The main issue is the lack of basic courtesy to you neighbors and community and environment!

I haven't read too many comments, but as I've grown up (a lot) over the 4-5 years I've been here in san francisco, I'm realizing there are some very foul things about the world, and the only way it can change is if things like this happen and create positive outcomes. Instead of just suing you because they "heard" of a problem, they should have sent over an officer to first investigate the situation. If you (Mr. House) had infact been burning garbage, that's another story, but if you've really been 100% efficiently disposing of your waste, then YEAY! I think it's unconstitutional (whatever that means anymore...) to make people PAY for anything... (like getting taxes done...) I hope you are still reading this Mr. House because I'd like to help you anyway I can!!! I'm only a college student, but I think it's time I started helping our world...

Several years ago, while living in Oregon, I had the same thing happen to me. My wife and I, produced almost zero trash. What little bit, we did throw away (about a pick-up load/yr.), I hauled to the trash transfer site, myself. The city threatened to prosecute me, if I didn't, pay someone to drive past an empty trash can, once/week.

Trash disposal is far too expensive, it's not market oriented but controlled by govt union goons, essentially a captive monopoly controlled by political hacks, we need free market trash disposal.

In my eyes him recyling and even burning his trash is so much better then having his trash picked up and taken to landfills. The city of San Carlos have a history of distorting the truth and trying to bully the citizens. Looks at the way they re-sign some head of their department to a new contracts, looks at some of their ex-mayor who are convicted in court for falsifying bills and records, looks at their promises to listen to the citizens of the city, but unless you know somebody they dont care. The Department of the building have some shady inspectors and one unqualified chief( liars too), so i am not surprised by this phony lawsuit. If mr. House is burning his trash then show us the tickets if not not they should shut up and pay for the cost of the law suit from there own pocket and not from the people of San Carlos. No one was in the house, no cans no waste no nothing!!I live in SC. I was told by phone the garbage fee was part of the water/ sewer/ tax bill or some such nonsense and could not be terminated even if no waste was being picked up. I will bet, if you went town to town across the country you'd find this goes on quite routinely. We have ourselves to blame for putting these type of idiots (people who make up these "rules")in public office.
